Will redefine the laws regarding marriage to remove gender specific language in response to same-sex marriage being recognized in Oregon by a federal Judge. The Oregon Constitution has not been amended and marriage is between a man and a woman. This bill violates our Standing Constitution.

Same-sex marriage has been recognized in Oregon since May 19, 2014, when a U.S. federal district court judge ruled that Oregon’s 2004 state constitutional amendment banning such marriages discriminated on the basis of sexual orientation in violation of the Equal Protection Clause of the federal constitution. This action did not amend the Constitution.

Unless the Oregon Constitution is amended the policy is still in effect.

Article XV

Section 5a. Policy regarding marriage. It is the policy of Oregon, and its political subdivisions, that only a marriage between one man and one woman shall be valid or legally recognized as a marriage.

HB 3231 will redefine the laws regarding the parents of a child by marriage to remove gender specific language in response to same-sex marriage being recognized in Oregon by a federal Judge. The Oregon Constitution has not been amended and marriage is between a man and a woman. This bill is assuming policy has changed..

By changing and removing: A [man] to say a person. Is removing the fact that it takes a Man to produce a child from a woman. Where as it could remove the biological father being recorded on the birth record, as that information on birth records is important to be able to trace the genetics.
