HB 2930 Creates new Commission regarding Law Enforcement Standards

This bill establishes the Commission on Statewide Law Enforcement Standards of Conduct and Discipline for arbitrator to determine reasonableness of disciplinary action imposed by law enforcement agency. Removes the discipline matrix or discipline guide as a mandatory subject of collective bargaining for law enforcement.

Fiscal Responsibility
Requires allocations of General Funds.

Limited Government
As a condition of enforceability, an arbitration award that orders the reinstatement of a public employee or otherwise relieves the employee of responsibility for misconduct must comply with clearly defined public policy in statute or judicial decisions. Resolution of disputes over conditions and terms of a contract may be resolved through binding arbitration. House Bill 2930A removes the discipline matrix or discipline guide as a mandatory subject of collective bargaining for law enforcement, establishes the Commission on Statewide Law Enforcement Standards of Conduct and Discipline, and requires an arbitrator to apply a reasonable person standard. Requires that the standard arbitrators apply in police discipline cases be just cause, as defined in ORS 236.350. Sets the standard of evidence at preponderance of the evidence, requires the employer to show: (1) the officer engaged in misconduct, and (2) the discipline met the statutory just cause standard.

    After last summer’s nightly riots in Portland, and the constant abuse of law enforcement officers, they are increasingly placed in positions where disciplinary actions are increasingly likely, especially due to the hostility of leftist prosecutors. Therefore, it makes sense that a set of applicable standards subject to arbitration be put in place.

    We need to protect our police officer so they and do their job to service & protect We the People of Oregon! The liberals in our government should be held accountable for their part of not letting the police do their job! Every signal business that lost their business’ bc the police were told not to stop the rioters should pay for the loses of the business owners or sit in jail!
