HB 4208A Non-Lethal Means of Crowd Control/Dispersal.

VOTE:YES – Governor Signed
Status (overview) of bill:https://olis.oregonlegislature.gov/liz/2020S1/Measures/Overview/HB4208

This bill allows law enforcement officers to deploy tear gas to control / disperse riot crowds as long as they follow certain procedure.

Personal Choice and Responsibility
This amended bill shows that the legislature realizes that the decision to deploy tear gas is a command decision that must be left to law enforcement officers on scene. This legislation affects only its use as a crowd control / dispersal tool.

Local Control
The procedure calls for only two announcements of intent to deploy the gas separated by sufficient time for the crowd to respond to the first announcement and disperse. The caveat to this “rosy” outlook is in recognizing the point at which a large protest has crossed over into riot ground that meets the elements of ORS 166.015(1)
