Adjusts public records law ORS 192.324 to rely on ORS 205.320 for establishing fees for public records requests. ORS 205.230 already establishes a fee schedule for records from the Clerk’s offices.

ORS 205.320 is proposing an update in HB 3383, which reads: For supplying to private parties copies of records or files, including by electronic delivery of images, not more than [$3.75] $5 for locating a record requested by the party and 25 cents for each page. As used in this subparagraph, “page” means one side of a sheet 14 inches, or less, long and 8-1/2 inches, or less, wide

Currently, there are two statutes that could be interpreted differently regarding the fees that county clerks can charge for certain documents upon a public records request. The fees in ORS 205.320 reflect the array of services that county clerks provide and the ability for clerks to recover the costs of performing these services. These fees were codified in that statute after a statewide fee study and are periodically updated to reflect costs. House Bill 3385 makes a slight amendment to Oregon’s public records law which clarifies that the fees listed in ORS 205 apply to public records requests for documents from county clerks. This will halt the abusive charges that the Secretary of State came up with to stop public record request on elections.
