The Act changes some laws about agency actions. Before an agency gives notice of intent to adopt a permanent rule that will result in new requirements, changes to compliance obligations or increased costs for persons regulated by the agency, the agency shall appoint an advisory committee as described in this section. The US Supreme Court decision in Chevron prohibits agencies to make law by rules. Oregon has been vary lax in passing their responsibility to agencies for rules. This bill makes government more transparent, help ensure the laws passed accurately translate into the rules implemented by state agencies, and prevent agency overreach.
The LC opinion found that OSHA exceeded its statutory authority in expanding application of the ag-labor housing rules to single family homes. (Article)
