The Act makes changes to the gun permit and transfer process. The Act goes into effect when the Governor signs it as a emergency so citizens can’t challenge it. This seems unethical since it is already in the courts, plus it state that a challenge must be made in Marion County Circuit Court – so which is it?
This is pure power grab over Measure 114, which is still in court, and they made it worse. It doubles the fees and doubles the time to issue “permits”. The bill also requires that any legal action take place in the courts least likely to side with gun owners. The deck is stacked, Democrats are determined to crush gun rights in Oregon.
The bill modifies the firearm permit provisions of Ballot Measure 114 (2022). HB 3075 introduces several measures to increase government control over firearm ownership and transfer in Oregon:
- Expanded permit process: Permits are now required for firearm transfers, with a change from 30 to 60-day waiting period for approval or denial, and written notice for denial.
- Increased fees: The maximum fee for an initial application increases from $65 to $150. Specifies the portion of the fee payable to the Department of State Police for conducting a criminal background check.
- Stricter eligibility requirements: Establishes a new program for law enforcement approving instructors – lacks added funding. Applicants must provide proof of completion of a firearm safety course and pass a criminal background check.
- Requires legal challenges limited to Marion County Circuit Court.
Provides that permits are not required for firearm transfers until July 1, 2026. Establishes a temporary exception to the permit requirement for the transfer of certain firearms until July 1, 2028. Establishes a permanent exception to the permit requirement for active duty law enforcement and military. Modifies the affirmative defense language for the large capacity magazine provisions of Ballot Measure 114 (2022). Declares an emergency, which isn’t justified with these delays to implement.
In an information hearing, not one testimony gave facts on reduced crime when people carry or facts on how many criminals abide with gun restrictions, or a direct link to this bill.

Just when you think the Democrats can’t get anymore tyrannical when it comes to attempting to eviscerate the Second Amendment, they sink to another new low with each legislative session. This is nothing less than a temper tantrum because they have thus far lost in court.
We really ought force onto these cretans laws that when politicians propose, attempt to, or pass legislation that is determined unconstitutional and a violation of our rights that those politicians be immediately resigned and banned from public service, all pension and benefits revoked… I guess they can still have COBRA, but that’s all!

Through pure apathy and ignorance, m114 passed. Now we’ve got this unconstitutional nightmare. What if you can’t afford to pay the fee, you don’t get to own the firearm of your choice? Relegated to firearms that are JUST AS DANGEROUS, but not as trendy? This is blatant, and adding the provision to allow those purchases is just an attempt to flavor this pill in a way some find palatable, who might not have previously stood opposed.

Negative Effects of Limiting Magazine Capacity in Oregon
Gun control laws, such as restricting magazine capacity, are designed to reduce violence, but they often fall short when it comes to addressing Oregon’s criminal element. Instead, these measures can and will disproportionately burden law-abiding citizens while leaving criminals free to exploit the gaps.
1. Criminals Ignore the Law
Criminals don’t obey gun laws. Limiting magazine sizes to, say, 10 rounds won’t stop them from sourcing high-capacity magazines through Oregon’s existing illegal firearms market. This leaves lawbreakers armed as they please, while law-abiding residents—especially in rural areas with delayed police response—face tighter restrictions.
2. Self-Defense Takes a Hit
In Oregon, where property crimes or home invasions can turn violent, a limited magazine could hinder self-defense. Facing multiple attackers, a homeowner might need more than a handful of rounds to protect themselves. While such situations are uncommon, they’re not impossible, and capping firepower tilts the advantage toward criminals.
3. Enforcement Falls Flat
Enforcing magazine limits in Oregon’s diverse landscape is a logistical nightmare. Criminals won’t register or turn in their high-capacity magazines, and tracking illegal ones strains already stretched law enforcement resources. The result? Compliant citizens are restricted, while the criminal element operates unchecked.
4. Emboldening Criminals
If criminals know their victims are capped at fewer rounds, they might grow bolder. In a state seeing upticks in violent and property crimes, this could spark more aggressive behavior. Plus, law-abiding Oregonians—hunters and sport shooters included—face added constraints that don’t touch the criminals at all.
In essence, limiting magazine capacity in Oregon sounds good on paper to the uneducated but does little to rein in criminals. It’s a policy that weakens the law-abiding while letting the lawless do what they’re going to do.
The crazies in the Oregon legislature have no where to go, but try to use their own votes to create further discord with the law! Like it or not we are granted use of firearms by the Second Amendment of the US Constitution. The law does nothing to protect us from criminals and the State does nothing to these criminals.
